Clustered Subdivision Requirements
11.05.010 Purpose and Intent
The cluster subdivision option is provided by the Town to encourage creativity in subdivision design, to encourage the achievement of the goals and policies of the Town’s General Plan and to allow for the protection of the natural features and the provision of features and amenities for the subdivision site and the Town. Full compliance with all the provisions of this title, and all other applicable local, state and federal requirements is required.
11.05.020 Use Regulations
The cluster subdivision option may be permitted, or required, in any zoning district which allows single-family residents of the Town by the Town Council, following the receipt of a planning commission recommendation. An application for a cluster subdivision shall be considered concurrently with an application for subdivision approval. All use requirements of the zoning district in which the cluster subdivision is located shall apply; and the application requirements for either a preliminary subdivision plat application or final subdivision plat application, as applicable, shall apply.
11.05.030 General Requirements
A. The total number of dwelling units allowed in a cluster subdivision shall be the same as the number allowed by the minimum lot area requirements of the zoning district in which the proposed cluster subdivision is located. Any land(s) used for other uses shall not be included in the area for determining the total number of allowed dwelling units. The total number of allowed dwelling units must also recognize any critical area requirements that may be applicable to the development site as identified in the Elwood Town Zoning Ordinance.
B. The land(s) proposed for a cluster shall be in a single ownership or the application for a cluster subdivision shall be filed jointly by the owners.
D. A "cluster" is a designed grouping of residential lots of two (2) or more lots which may be used as a repetitive motif to form a series of clusters. Each cluster grouping shall be separated by either an agricultural area or natural open space to form the larger cluster subdivision.
E. Total open space areas for a cluster subdivision must be thirty three (33) percent or greater than the total area of the subdivision.
F. All roads developed within the cluster subdivision shall be designed and constructed in accordance with the Town road standards, and shall also be designed in a manner as to limit the amount of impact on the open space areas of the subdivisions.
G. The use of the cluster subdivision option shall be required for all major subdivisions (20 Lots or more) to reduce the loss of valued agricultural and open space lands.
11.05.040 Development Standards
A. Minimum Lot Area: The minimum lot area may be reduced below the minimum lot area required by the zoning district requirements in which the cluster subdivision is located, as recommended by the planning commission, and as approved by the Town Council. However, no lot shall be less than one-half (1/2) acre, recognizing the need to provide adequate culinary water and sanitary sewer services.
B. Minimum Lot Width and Minimum Yard Requirements: The minimum lot width, side yard, front yard and rear yard requirements of the zoning district in which the cluster subdivision is located, may be reduced as recommended by the Planning Commission, and as approved by the Town Council. However, no required side yard shall be less than twelve feet (12'), no required front or rear yard shall be less than thirty feet (30'), and no corner side yard shall be less than twenty feet (20').
C. Use And Height Requirements: All cluster subdivisions are required to comply with the use and height requirements of the zoning district in which they are located.
D. Required Services: The proposed cluster subdivision must comply with the requirements for culinary water, sewage and storm drainage as required for preliminary subdivision plat applications, final plat applications, minor subdivision applications, or property split subdivision applications, as applicable.
E. On Site And Off Site Improvements: The proposed cluster subdivision may be required to provide on site and off site improvements, facilities and amenities, as required for final plat applications, as applicable.
11.05.050 Open Space Provision and Maintenance
All areas to be preserved for open space areas as a result of a cluster subdivision approval shall be preserved in perpetuity. These areas shall only be used, and shall be maintained in accordance with the conditions of the cluster subdivision approval, as recommended by the Planning Commission, and approved by the Town Council. Such area(s) shall be noted on the subdivision plat as open space area with future residential and commercial development prohibited.
11.05.060 Cluster Subdivision Application
An application for a cluster subdivision approval shall be submitted to the Town in accordance with the requirements for a preliminary subdivision plat application, as applicable, and as required by this title.
